The short answer
India has a large IT and business-process services industry, and a small business can reach a virtual assistant (VA) there in three ways: as an independent contractor, through an agency or outsourcing company that employs the person, or as an employee of a local employer of record that you direct day to day. The choice turns on how many hours you need, how much control you want over the person’s time, and how much you want a provider to carry the payroll and compliance work.
RemoteStaffingWiki’s guidance for a first hire who will work full time on your tasks and your schedule is to use an employer of record, and to keep the contractor route for defined, deliverable-based work. That is the site’s own judgement, not a rule. The sections below set out the evidence: why India, what the pay tables show, how the labour codes and the Digital Personal Data Protection Act, 2023 touch a VA role, and how the time zones work. For the wider market, see the India hiring guide and the virtual assistant role guide.
Why India for virtual assistant, admin and back-office work
Start with scale, and be clear about what the figures do and do not show. The National Association of Software and Service Companies (NASSCOM), the Indian technology industry body, says on its Strategic Review 2026 page that India’s tech sector is expected to cross US$315 billion by FY26 and that direct tech-sector employment is projected to reach about 6 million in FY26, up 2.3 percent on the year, a net addition of 135,000 employees. Invest India, the government’s investment promotion agency, describes the IT and business process management (IT-BPM) sector as a cornerstone of the country’s digital economy and gives a technology workforce of 5.43 million, of which 2 million are described as digitally skilled.
Those are technology-industry totals. They are not a count of virtual assistants, and they do not tell a small buyer how many individual administrators are available to hire. Treat them as evidence that India has a deep services industry, an established IT-BPM industry and a large employment base, rather than as a measure of the supply of VAs. Invest India attributes the sector’s strength to a large talent pool supported by educational institutions and specialised training programmes.
Invest India’s IT-BPM page also says India’s cities offer significant cost savings in terms of cost per full-time employee, cost of living and average office rent compared with alternatives such as Beijing, Manila, Singapore and Kuala Lumpur. The page is investment-promotion material and gives no figure, so it supports the general direction of the argument but not any specific saving. The pay table later on this page is the better guide to what you would actually budget.
English and what the ranking means
India ranks 74th of 123 countries in the EF English Proficiency Index 2025, with a score of 484, in the index’s low band. For an administrative role that means testing, not assuming: the index samples self-selected online test-takers, so it describes a national average and says little about an individual VA who has worked with international clients. The India vs Philippines comparison sets the two markets side by side if language fit is your main concern.
Which tasks suit India-based VAs
The tasks that suit a remote VA are the same anywhere: inbox and calendar management, data entry and cleanup, research, bookings, document preparation, CRM updates and routine customer-support queues. The list of tasks to outsource to a virtual assistant goes through them, and the VA versus executive assistant comparison helps you decide how much judgement and autonomy the role needs. The India guide’s pay table lists virtual assistants, data entry specialists and customer support agents as separate roles.
What a virtual assistant costs in India
The salary table on this page reuses the rows in the India country guide for three closely related roles: virtual assistant, data entry specialist and customer support agent. Each row comes from a published Indian salary and company-review site, as of October 2026 (named in the Sources list and in each row’s source cell). The monthly and annual dollar figures are conversions at INR 95.07 to the US dollar, shown with the rupee figure beside them so you can re-convert at your own rate.
How to read the band
For the virtual assistant row the band runs from INR 3 lakh to INR 5 lakh a year, which is INR 25,000 to INR 41,667 a month. That band is built from the experience bands shown on the source page, taking the low end of the lowest band to the high end of the highest. The page shows the entry band (1 to 3 years) starting at INR 3 lakh and the top band (6 to 9 years) ending at INR 5 lakh. The data entry row uses the page’s typical range instead of experience bands, and the customer support row uses experience bands of 1 to 6 years. The basis is written into each row’s source cell.
Three cautions apply to every row. First, these are salary figures for employees reported on a job-review site, not contractor day rates or agency prices. Second, they exclude employer statutory contributions and any provider fee, which the rows flag with “plus PF/gratuity statutory load”. Third, a salary band is a range of reported pay, not an offer, so individual quotes can fall outside it.
The US benchmark
The last row of the table is a US benchmark from the Bureau of Labor Statistics (BLS): secretaries and administrative assistants, except legal, medical and executive (SOC 43-6014), with a median of $47,540 a year ($22.86 an hour) in May 2025 from the Occupational Employment and Wage Statistics survey. RemoteStaffingWiki uses it as a proxy only. It measures on-site US administrative workers employed directly, not remote VAs, so it shows the scale of onshore administrative pay and nothing more. The two sets of figures come from different kinds of source and should not be divided into a savings percentage.
For a full cost view that adds fees, tools and management time, read the all-in cost of hiring a virtual assistant, what virtual assistants are paid by region and how a virtual assistant price is built. To add India’s employer contributions to a salary, use the employee cost calculator.
Contractor, agency or employer of record
A VA in India can reach you through three structures. The differences are about who employs the person, who carries Indian compliance, and how much of the person’s day you can direct.
| Factor | Independent contractor | Agency or outsourcing company | Employer of record |
|---|---|---|---|
| Who employs the VA | The VA runs their own business and invoices you | The agency employs the VA and sells you their time or a defined service | The employer of record employs the VA under Indian law |
| Who directs the daily work | The VA decides how the work is done; you set deliverables | Varies by contract: from a managed service to the agency’s staff working under your direction | You direct the work, as you would for an employee |
| Indian payroll and statutory registrations | The VA’s responsibility | The agency’s responsibility | The employer of record runs them and charges a fee |
| Replacement or absence cover | None unless the VA arranges it | Check whether the contract provides cover | You recruit a replacement; the employer of record handles the exit paperwork |
| Main risk to watch | Treated as an employee if you control hours, methods and exclusivity | Fees, subcontracting and how data is handled | Fee, notice terms and which Indian rules apply |
The comparison pages go deeper on each choice: employer of record versus contractor, freelancer versus agency versus dedicated team, marketplace versus agency versus employer of record and staff augmentation versus BPO. The glossary entries for employer of record, independent contractor and business process outsourcing define the terms.
India’s labour codes and contract staff
Indian employment law changed on 21 November 2025, when the four labour codes took effect; the labour codes explainer and the India guide set out what applies and what was still being notified in autumn 2026. Three points from those pages matter for a VA. Whether someone is an employee or an independent contractor depends on the working arrangement, not the label. The Ministry’s release says every worker is to receive an appointment letter. And state rules govern most private employers, so ask any provider which rules apply to your hire today and who is responsible if they change.
In practice that means the contractor route fits a VA who has several clients, sets their own hours and methods, and delivers defined outputs. It fits poorly a person who works your hours, uses your tools all day and works for you alone. The misclassification glossary entry and the misclassification risk tool help you test a specific arrangement. Have an Indian lawyer confirm the classification before you rely on it.
Statutory costs on top of salary
An employee in India carries employer contributions under Indian social security and labour rules, including provident fund, state insurance where it applies, and gratuity. EPF applies on wages up to INR 15,000 a month under the EPFO’s published rules; trade press reported a rise to INR 25,000 from 17 September 2026 that RemoteStaffingWiki has not confirmed against an EPFO notification, so ask for an itemised quote that states the ceiling used. Rates and ceilings change, so budget from a current schedule, not a figure quoted elsewhere, and run the numbers in the employee cost calculator.
Data protection when a VA handles customer data
An administrative VA often sees personal data: customer names and emails, order details, contact lists, invoices, sometimes health or payment information. The Digital Personal Data Protection Act, 2023 is India’s data protection statute, and its text is published in the Gazette of India. The points below come from the Act’s published text and are a summary, not legal advice. The India guide covers the Rules made under the Act and their phased start dates, so check it for the current timetable.
- Scope (section 3). The Act applies to processing of digital personal data within India, and also to processing outside India in connection with offering goods or services to people in India. A VA working in India on personal data is processing within India.
- Lawful grounds (section 4). Personal data may be processed for a lawful purpose with the person’s consent or for “certain legitimate uses”, and section 7(i) lists purposes of employment, including safeguarding the employer from loss, such as protecting confidential information and trade secrets. This is the clause that bears on records about the VA themselves.
- Responsibility stays with the data fiduciary (section 8). A data fiduciary is the party that decides why and how personal data is processed. Section 8(1) makes it responsible for compliance regardless of any agreement to the contrary and for processing done on its behalf by a processor, section 8(2) requires a valid contract when a processor is engaged for activities related to offering goods or services to individuals, and section 8(5) requires reasonable security safeguards to prevent a personal data breach.
- Breach notice (section 8(6)). On a personal data breach the fiduciary must notify the Data Protection Board and each affected person in the prescribed form and manner.
- Penalties (Schedule). The Schedule lists a penalty of up to INR 250 crore for breach of the duty to take reasonable security safeguards, and up to INR 200 crore for failing to give notice of a breach.
Section 17(1)(d) is worth reading if your VA serves customers outside India. It provides that, except for sub-sections (1) and (5) of section 8, Chapter II of the Act does not apply where the personal data of people not within the territory of India is processed under a contract with a person outside India by a person based in India. Whether that provision covers your arrangement depends on the facts, and it does not remove your own obligations under US or UK law. Ask an Indian lawyer how it applies before you rely on it. The data processing agreement glossary entry explains the contract that normally records these duties.
A data-handling checklist for VA engagements
The following is RemoteStaffingWiki’s own checklist, not a statutory requirement:
- Give the VA the least access the tasks need, through named accounts and a password manager, never shared logins.
- Keep customer data in your systems; do not let the VA download exports to a personal device or personal email.
- Put confidentiality, data-handling and return-or-deletion terms in the contract, and name who must notify whom of a breach and how quickly.
- Remove access the day the engagement ends and keep a record of what was removed.
Time zones and working hours
India uses a single time zone, India Standard Time at UTC+5:30, with no seasonal change. US Eastern time is UTC-5 in winter and UTC-4 in summer, so India is 10.5 hours ahead of New York in US winter and 9.5 hours ahead in US summer. For the UK, India is 5.5 hours ahead in UK winter and 4.5 hours ahead in UK summer. A standard Indian office day therefore finishes before the US day starts, so a VA serving US customers needs a shifted evening schedule or an asynchronous handover. Check your own dates with the time-zone overlap tool.
| VA shift in India (IST) and client location | Same shift in client local time, winter | Same shift in client local time, summer | Overlap with a 9:00 to 17:00 client day |
|---|---|---|---|
| 18:00 to 03:00 IST, US Eastern client | 07:30 to 16:30 (EST) | 08:30 to 17:30 (EDT) | About 7.5 hours in winter, 8 hours in summer |
| 09:30 to 18:30 IST, UK client | 04:00 to 13:00 (GMT) | 05:00 to 14:00 (BST) | About 4 hours in winter, 5 hours in summer |
| 12:30 to 21:30 IST, UK client | 07:00 to 16:00 (GMT) | 08:00 to 17:00 (BST) | About 7 hours in winter, 8 hours in summer |
A late shift for a US client means the VA works through the Indian night, so agree the schedule in the contract and ask how the person stays safe and rested. The night shift and time-zone premium guide covers pay adjustments. Agree a holiday calendar covering Indian and your own public holidays at the outset.
Paying a virtual assistant in India
How you pay depends on the structure. An employer of record or an agency invoices you in your currency and pays the VA itself. A contractor is paid by an international bank wire, a multi-currency account or a payout platform, each of which charges fees in different places. The guide to paying international contractors sets out the cost of each method with a dated example and covers the tax forms around the payment. Confirm the fee schedule before you send money, and agree the invoicing currency and the date payments are due in the contract.
Vetting and interview checklist
This checklist is RemoteStaffingWiki’s own guidance for screening an administrative VA. Adapt it to the role:
- Task test. Give a paid, time-boxed task from your real work, such as sorting a sample inbox, cleaning a short spreadsheet or drafting a reply to a customer, and review the result for accuracy as well as speed.
- Written English. Ask for a short email in the voice you use with customers, and a live call to hear spoken English. Describe the English the job needs rather than asking for fluency.
- Tools. Ask which email, calendar, spreadsheet and project tools the person has used, and have them show a task in your tool set.
- References. Speak to a previous client or manager about reliability, handling of mistakes and communication.
- Continuity. Ask what happens to your work when power or internet fails, what backup the person uses and how much notice they give before time off.
- Current employment. Candidates who are already employed may need to serve notice before starting, so ask early.
Identity and criminal-record checks depend on the country. For India, the Ministry of External Affairs’ Passport Seva portal handles the application for a police clearance certificate, and the applicant applies through Passport Seva. The international background checks guide covers what a check can and cannot show, and the consent steps US employers need. Do not run a check without the person’s written agreement.
