Night Shift and Time Zone Premiums for Offshore Staff

What it costs to have offshore staff work US or UK hours: the statutory night-work rules in the Philippines, India, Mexico, Colombia and South Africa, how premiums stack, a worked monthly example and alternatives to a night shift.

Published October 2026 · Last reviewed November 2026 · RSW Editorial

The short answer

Putting offshore staff on US or UK business hours usually means someone works at night in their own country. In several countries the law then adds money to the pay slip. In the Philippines the statutory floor is an extra 10 percent of the hourly wage for each hour between 10 pm and 6 am, and that sits on top of any overtime, rest-day or holiday premium. In Colombia night work carries a 35 percent surcharge. South Africa requires an allowance or shorter hours. Mexico shortens the night working day instead of naming a percentage. In India, any night allowance is set by contract and state rules; the OSH Code sets conditions, not a percentage, including conditions for women who work at night.

RemoteStaffingWiki’s guidance is to price the night shift into the first quote, not to discover it at the first payroll. The sections below give each country’s rule with its statute, show how the Philippine premiums stack, work through one illustrative month, explain how the cost is passed on, and cover alternatives to a night shift.

Update (4 November 2026). Mexico’s shorter working week is now a published schedule rather than a proposal: the ordinary weekly maximum is 48 hours in 2026, 46 in 2027, 44 in 2028, 42 in 2029 and 40 in 2030, under a constitutional reform in the Diario Oficial on 3 March 2026 and a Ley Federal del Trabajo reform on 1 May 2026 (Tax Today México). The Mexico section below quotes the older consolidated text for night shifts and overtime, so confirm the current article wording before you price a night schedule there.

Why the clock changes the bill

A time-zone gap is not just inconvenient; it decides which hours of the day the employee works. The Philippines uses a single time zone, UTC+8, which our Philippines hiring guide puts 13 hours ahead of US Eastern time in US winter and 12 hours ahead in US summer. Applying that offset, a 9 am to 5 pm Eastern day in winter is 10 pm to 6 am in Manila, which falls entirely inside the statutory night window. In US summer the same Eastern day is 9 pm to 5 am, so seven of the eight hours fall inside it. That arithmetic is RemoteStaffingWiki’s own, based on the guide’s offsets, and daylight-saving dates differ between countries, so check your own dates with the time-zone overlap tool.

Three things can change the cost of an off-hours schedule: a night differential or surcharge for hours inside a legal night window; overtime, rest-day and holiday premiums, which can stack on top; and conditions rather than money, such as shorter legal shifts, consent, transport and health checks. The window differs by country, so the same shift can attract a premium in one place and none in another. The table sets the rules side by side.

Philippines: night differential, overtime and how they stack

The statute

Article 86 of the Labor Code provides that every employee shall be paid a night shift differential of not less than ten percent of the regular wage for each hour of work performed between ten o’clock in the evening and six o’clock in the morning. Article 87 sets overtime at the regular wage plus at least 25 percent for work beyond eight hours a day, and plus at least 30 percent of the holiday or rest-day rate for work beyond eight hours on a holiday or rest day.

The Department of Labor and Employment’s 2024 Handbook on Workers’ Statutory Monetary Benefits restates the night rule as an additional 10 percent of the corresponding hourly rate for the night work, and says the minimum differential varies according to the day on which the night work is performed. That sentence is the key to stacking: the 10 percent applies to the hourly rate that is already enhanced for the day.

Who is covered

The handbook lists the exceptions to the night differential: government employees, retail and service establishments regularly employing not more than five workers, domestic workers, certain managerial employees and managerial-staff officers who meet the handbook’s tests, and field personnel and those whose time and performance are unsupervised by the employer. RemoteStaffingWiki’s guidance is to classify a remote employee on set hours for a foreign client under the handbook’s categories, confirm the position with DOLE or local counsel, treat a fixed-schedule night hire as covered unless advised otherwise, and state the position in the contract.

How the premiums stack

The handbook’s computation guide multiplies the day factor, the night factor and, where relevant, the overtime factor. The table reproduces the rows most relevant to a staff member on a fixed night schedule. All figures are multiples of the basic hourly rate.

A regular-holiday night hour is paid at 2.20 times the hourly rate against 1.10 on an ordinary day (3.718 with a rest day and overtime), because the 10 percent is applied to the holiday multiple. Ask any provider how holiday coverage is priced.

For role pay levels see the Philippines salary table in the Philippines guide, and for how a recent wage order affects the base, read the Philippines minimum wage explainer. A typical night-shift role is covered in the customer support agent guide.

Worked example (RemoteStaffingWiki’s illustration)

The example below shows how the statutory minimums above change a monthly cost. It is an illustration of arithmetic, not a quote, and it is not a forecast of what any provider will charge.

Assumptions

  • Role and base pay: the Customer Support Agent row of the Philippines guide’s salary table, which gives PHP 18,000 to PHP 39,000 a month (about US$300 to US$650 at the guide’s rate of roughly PHP 60 to the dollar), as of 2026 (the guide names the pay-survey source). The example uses the two ends of that range.
  • Schedule: 22 working nights a month of 8 hours each, all on ordinary working days, scheduled 9 am to 5 pm US Eastern.
  • Hourly rate: monthly pay x 12 / 365 for a daily rate, divided by 8. The handbook uses a 365-day factor for monthly-paid employees; this is a simplification.
  • Night differential: 10 percent of the hourly rate for each night hour inside 10 pm to 6 am. In US winter all 8 hours qualify; in US summer 7 do.
  • Overtime: 8 extra hours in the month on ordinary days, at night, paid at the handbook’s 137.5 percent multiple for ordinary-day night overtime.
  • Not modelled: 13th-month pay, social contributions, leave, holidays, equipment and provider fees.

On these assumptions the two premiums add roughly 12 percent to base pay in a winter month and roughly 11 percent in a summer month, because the same ratio applies at both ends of the pay range. That ratio is a feature of the assumptions, not a benchmark: a schedule with no overtime would add only the differential, and a month with holiday work would add more. Change the inputs, then add contributions, leave and provider fees using the remote hiring cost calculator.

India: hours, overtime and night work for women

India’s four labour codes took effect on 21 November 2025, as described in our India labour codes explainer and the India hiring guide. For night work the relevant one is the Occupational Safety, Health and Working Conditions Code, 2020. The government’s factsheet on the Code states that no employee shall be required to work more than 8 hours in a day and 48 hours in a week, that overtime is paid at double the normal wage rate, and that women may work at night, meaning before 6 am and beyond 7 pm, with their consent, with the employer making adequate arrangements for safety, facilities and transportation.

  • The OSH Code sets conditions for night work rather than a fixed premium; settle any night allowance in the employment contract and check the applicable state rules.
  • If the night team includes women, consent, transport and safety arrangements are conditions of the schedule. Ask how they are met.
  • Rules are being finalised state by state. The Central Rules apply only where the central government is the appropriate government, and on 24 September 2026 the Labour Secretary said the Centre expected all states and Union Territories to publish their rules by 31 October 2026, with ten already done and the rest at draft stage (Business Standard, as reported in our India guide). Confirm which state’s rules govern.

Mexico: a shorter night, not a named percentage

Under Article 60 of the Ley Federal del Trabajo the night shift is the period between eight in the evening and six in the morning, day work runs from six in the morning to eight in the evening, and a mixed shift that includes three and a half or more hours of night work is treated as a night shift. Article 61 caps the maximum shift at eight hours for day work, seven for night work and seven and a half for a mixed shift. Overtime is paid at 100 percent more than the hourly wage under Article 67, and at 200 percent more for overtime beyond nine hours a week under Article 68. The text cited is the consolidated law as published on gob.mx, last reformed on 12 June 2015; the Labour Law decree of 1 May 2026 amended Articles 58, 59, 61, 66, 67, 68, 69, 71, 132 and 994, as described in our Mexico hiring guide and the nearshoring and workweek explainer, lowering the ordinary weekly maximum to 46 hours in 2027, 44 in 2028, 42 in 2029 and 40 in 2030 and changing the overtime limits, so confirm the current article text before writing overtime or night-shift terms into a contract.

The Federal Labour Law shortens the night shift to seven hours rather than adding a percentage premium. Mexico City is on UTC-6 all year according to the guide, so a daily call with a US team does not need anyone to work at night. The night rules matter mainly for around-the-clock operations.

Colombia: a 35 percent surcharge, and a new start time

Colombia’s Ley 2466 of 2025, Article 10, rewrote Article 160 of the Substantive Labour Code so that night work is the period between 7 pm and 6 am the following day, and said the change takes effect six months after the law was sanctioned. Our Colombia hiring guide notes the law was sanctioned on 25 June 2025, so the new window applies from late December 2025. Article 168, as modified by Law 50 of 1990, sets the rates: night work is paid with a 35 percent surcharge over the value of day work; an extra day-time hour carries 25 percent; an extra night-time hour carries 75 percent; and the surcharges are applied separately, not cumulated.

Article 11 of the same law (Article 161 of the Code) says a worker whose agreed schedule falls at night is entitled to the night surcharge, with an exception for continuous-operation teams on shifts of up to six hours a day and 36 hours a week, for which there is no night or rest-day surcharge but the pay is for the full ordinary day. Article 14 (Article 179 of the Code) sets the rest-day and holiday surcharge at 100 percent, phased in at 80 percent from 1 July 2025 and 90 percent from 1 July 2026, with full application from 1 July 2027.

Colombia is on UTC-5 all year. RemoteStaffingWiki’s observation is that a US business day then sits mostly in the day window, while a UK or Australian business day can fall partly or wholly in the night window; count the hours before you accept a quote.

South Africa: allowance or shorter hours, plus transport

Section 17 of the Basic Conditions of Employment Act defines night work as work performed after 18:00 and before 06:00 the next day. An employer may require or permit it only if so agreed and if the employee is compensated by an allowance, which may be a shift allowance, or by a reduction of working hours, and if transport is available between home and workplace at the start and end of the shift. The Act sets no percentage for the allowance. Where an employee works regularly after 23:00 and before 06:00, meaning more than one hour in that period at least five times a month or 50 times a year, the employer must tell the employee about the health and safety hazards and the right to a medical examination at the employer’s expense, and must transfer the employee to suitable day work where the employee has a night-work-related health condition and it is practicable. See the South Africa hiring guide for the earnings threshold above which the hours sections do not apply. Overtime under section 10 is paid at not less than one and a half times the wage.

Other markets

If your target country is not covered above, do not assume there is no premium. Ask the employer of record or local counsel to state the legal night window, any percentage or allowance, the overtime multiples and the holiday premiums in writing before you agree a schedule.

How employers of record and BPOs pass these costs on

Who pays depends on who the employer is. With an employer of record, the person is employed under local law, so the statutory premiums are the employer’s obligation and, in RemoteStaffingWiki’s experience of how these arrangements are structured, are billed back to you as part of the cost of that employee. With a business process outsourcing (BPO) arrangement, the provider employs the team and prices the service per seat, per hour or per outcome; the night premium may be built into that rate rather than shown as a separate line.

The mechanics differ, so ask these questions before signing:

  • Is the night differential a separate line item, or is it included in a blended monthly figure? If it is blended, does the figure change between US winter and summer?
  • Are overtime, rest-day and holiday premiums passed through at cost, and who approves overtime in advance?
  • If a premium is waived because the person is classed as managerial, field or unsupervised, who carries the risk if a regulator or court disagrees?

Fixed night hours set by you can be evidence of employment whatever the contract is called, so take advice before treating a night-shift worker as a contractor.

Alternatives to a full night shift

A permanent night shift is not the only way to cover US hours. The options below trade the premium against other costs; they are RemoteStaffingWiki’s summary, and the fit depends on the role.

  • Shifted or split shifts. A team starts late afternoon and works into the evening, or splits the day into two blocks, so that only part of the schedule falls inside the legal night window. Hours that still fall inside the window keep the premium, and the Colombian window starts at 7 pm, so check each hour.
  • Follow-the-sun coverage. Teams in different regions hand work from one to the next so that nobody works through the night in their own region; see the follow-the-sun glossary entry. It needs more people and clear handoffs, and costs coordination time rather than night premiums.
  • Partial overlap with asynchronous work. Keep a few shared hours for live work and make the rest asynchronous, so that only the overlap hours need to be at night for the employee.
  • A nearer time zone. The Colombia and Mexico guides describe time zones close to US hours, where a day shift can cover a US business day; weigh English level, pay and local add-ons in those guides.

The time-zone overlap glossary entry and the overlap tool help you count the shared hours for any pair of locations. For capacity planning on a support desk, see customer support capacity planning.

Health and scheduling considerations

The International Labour Office’s information sheet on night work describes the potential health risks of night work as serious. It also describes the Night Work Convention, 1990 (No. 171), under which night work is all work performed during a period of not less than seven consecutive hours including the interval from midnight to 5 am, and which calls for regular health assessments, first-aid facilities, an alternative to night work for night workers certified unfit and for women during and after pregnancy, and pay that recognises the nature of night work. It adds that the principle of higher wage compensation for night workers is generally accepted in the laws of countries outside the European Union.

RemoteStaffingWiki’s judgement is that these points bear on schedule design: keep rotas stable where you can, name a backup for illness or a failed connection, and treat the health and safety provisions in South Africa’s section 17 and India’s Code as a floor, not a ceiling.

A checklist before you agree a night schedule

  • Convert your required hours into the worker’s local time for both halves of the year and count the hours inside the legal night window.
  • Ask for the night differential, overtime and holiday multiples in writing, with the statute.
  • Model an ordinary month and a month with public holidays, then add contributions and fees.
  • Confirm consent, transport and safety conditions where the law requires them, particularly in India and South Africa.
  • Compare the night-shift cost with a shifted shift, partial overlap or a nearer time zone for the same role.

Frequently Asked Questions

How much extra do Philippine night-shift workers get paid?
Article 86 of the Labor Code requires a night shift differential of not less than 10 percent of the regular wage for each hour worked between 10 pm and 6 am. The DOLE handbook applies that 10 percent to the hourly rate for the day, so it stacks on overtime, rest-day and holiday multiples. Some staff are excluded, such as certain managerial employees and field or unsupervised personnel, so confirm coverage in the contract.
Does a US 9 to 5 day fall inside the Philippine night window?
In US winter, 9 am to 5 pm Eastern is 10 pm to 6 am in Manila using the 13-hour offset in the Philippines guide, so all eight hours are inside the window. In US summer the offset is 12 hours and the day is 9 pm to 5 am, so seven of the eight hours are inside. This is RemoteStaffingWiki’s arithmetic; check your own dates with the overlap tool.
How do overtime and the night differential combine in the Philippines?
They multiply. The DOLE handbook computes a night hour of overtime on an ordinary day as 1 x 1.1 x 1.25, which is 137.5 percent of the hourly rate, and a rest-day night overtime hour as 1.3 x 1.1 x 1.3, which is 185.9 percent.
Is there a night shift premium in India?
Any night allowance in India is set by contract and state rules; the Occupational Safety, Health and Working Conditions Code sets conditions, not a percentage. The government factsheet on the Code sets 8-hour days and 48-hour weeks, overtime at double the normal wage rate, and conditions for women who work before 6 am or after 7 pm: consent and employer arrangements for safety, facilities and transport. Any night allowance is therefore a matter for the contract and the applicable state rules.
What changed for night work in Colombia?
Ley 2466 of 2025, Article 10, redefined night work as the period from 7 pm to 6 am, effective six months after the law was sanctioned. Night work carries a 35 percent surcharge under Article 168 of the Substantive Labour Code, an extra day hour adds 25 percent and an extra night hour adds 75 percent, and those surcharges are applied separately, not stacked.
What does South Africa require for night work?
Section 17 of the Basic Conditions of Employment Act defines night work as after 18:00 and before 06:00. It needs an agreement, an allowance or shorter hours, and transport at the start and end of the shift. The Act does not give a percentage. Regular work after 23:00 adds duties to warn of hazards and to offer a medical examination at the employer’s expense.
Who pays the night premium when I use an employer of record or a BPO?
With an employer of record the person is employed under local law, so statutory premiums are the employer’s obligation and are, in RemoteStaffingWiki’s understanding, billed to you as part of that employee’s cost. With a BPO the premium may be built into the per-seat or per-hour rate. Ask whether it is itemised, how holidays are priced and which night window and rates are assumed.
Are there ways to avoid a full night shift?
Yes. Options include shifted or split shifts, partial overlap with asynchronous work, follow-the-sun coverage across regions, and hiring in a nearer time zone such as Colombia or Mexico. Each trades the premium for other costs, such as coordination or more staff. Hours that still fall inside a legal night window still attract the premium.
