The short answer

India is a large market for software developers, and a first-time buyer can reach it in four different ways: a direct contractor, an employee through an employer of record, a dedicated team run by a local vendor (an offshore development center, or ODC), or a captive centre of your own (a global capability centre, or GCC). The right choice depends mainly on how many developers you need, how long you will need them and how much control you want over the people.

RemoteStaffingWiki’s guidance for a small business hiring one to five full-time developers is to start with an employer of record or a carefully scoped contractor arrangement and to look at a vendor-run ODC only when the team will pass roughly a handful of engineers and last well over a year. That guidance is the site’s own judgement, not a rule, and the sections below show the evidence behind each model.

This page covers one role in one country. For the country-wide picture, including cities, language, employer costs and data protection, read the India hiring guide. For the role itself, including skills to test and what the job involves, read the software developer role guide.

Why companies look at India for developers

The case rests on scale, and the figures below come from government and industry-body publications rather than from anyone selling developers.

  • India’s investment-promotion agency, Invest India, states that the country has a technology workforce of 5.43 million people, of whom 2 million are digitally skilled. It also reports a domestic technology sector with annual revenue of $54 billion in FY24, a startup ecosystem it describes as the third largest in the world with 114 unicorns, and growth of 7.8 percent in engineering research and development (ER&D) in FY24.
  • Invest India lists a cost advantage for Indian cities against Beijing, Manila, Singapore and Kuala Lumpur on cost per full-time employee, cost of living and office rent. It is a qualitative claim from an agency that promotes investment, so read it as a positioning statement, not an audit.
  • A study of global capability centres co-published with NASSCOM, with data as of March 2026, counts 2,117 centres in India across 3,728 units, employing 2.36 million people and generating $98.4 billion in revenue. It reports that 506 Forbes Global 2000 companies operate one, alongside 583 mid-market and 504 private-equity-backed centres. NASSCOM is India’s technology industry body.

Two cautions apply. First, these are national totals. They show that a deep market exists, not that any individual candidate is strong, and a headline workforce number says nothing about the one person you are about to interview. Second, Invest India and NASSCOM have an interest in promoting the sector, so use them for scale and direction, and use the salary table and the vetting steps below for decisions about a specific hire.

English is the other variable buyers ask about. In the EF English Proficiency Index 2025, India ranks 74th of 123 countries and regions with a score of 484, which is in the low band. The index samples self-selected online test-takers, so it describes a national average, not a developer who has worked with international clients for years. The practical response is the same for any country: test spoken and written English in a live conversation and a short written task, and describe the English the job actually needs.

Four ways to engage a developer in India

The engagement model decides who employs the developer, who carries the legal and tax obligations, and how much control you have over the person’s time. The four models below are the ones small and mid-sized buyers meet most often.

Engagement models for hiring developers in India
ModelWho employs the developerTypical fitMain trade-off
Independent contractorThe developer, through their own business or as a sole practitionerA defined project or a short engagement with clear deliverablesYou do not control daily hours or methods; if you do, the relationship may be treated as employment
Employer of record (EOR)A local entity that employs the person under Indian law while you direct the workOne to a few full-time developers without an Indian companyA provider fee on top of salary, and the person’s contract sits with the provider
Dedicated team through a vendor (ODC)The vendor employs the engineers and assigns them exclusively to youA longer engagement with a team that works as an extension of yoursYou pay a vendor margin per engineer and depend on the vendor’s retention and security practices
Captive centre (GCC)Your own Indian entityA large, long-term engineering operationEntity set-up, compliance, premises and management overhead that only pay back at scale
Summarised from the RemoteStaffingWiki comparison pages and the sources listed at the end. The fit column is the site’s judgement.

Independent contractor

Some Indian developers work as freelancers or through a small firm and invoice clients. This suits a defined project with a clear deliverable. If you set daily hours, direct the methods and rely on the person full time, the relationship may be treated as employment under Indian law, which would bring statutory obligations with it. The question to ask before you start is whether the person is genuinely running their own business.

The comparison of employer of record, agent of record and contractor of record explains how the three intermediary models differ and when each applies.

Employer of record

An employer of record employs the developer under Indian law, issues the appointment letter, runs payroll and statutory registrations and charges a fee, while you direct the daily work. For one to a few full-time developers without an Indian company, the India guide on this site describes it as usually the simplest lawful route. Ask any provider how it handles provident fund and state insurance registration, how notice and termination work, and who owns the intellectual property the developer creates.

Dedicated team through a vendor (ODC)

An offshore development center is a dedicated team in another country that works on the parent company’s software tasks as an extension of its in-house team. A commercial glossary describes four types: captive (owned by the parent), dedicated (run by a vendor and assigned to one client), hybrid and project-based. In a dedicated ODC the client directs day-to-day work, priorities and processes even though the vendor employs the engineers.

ODCs suit a sustained, multi-person engineering need; for one or two developers the management overhead of a vendor-run team is usually not worth it (RemoteStaffingWiki’s judgement).

Captive centre (GCC)

A GCC is a company-owned centre in India. The scale figures above show how widespread the model is among large companies, but a small business rarely needs one. A law-firm briefing on GCCs highlights entity set-up, lease commitments, the risk of creating a taxable presence and employee compensation obligations including gratuity. Many companies reach a GCC through a build-operate-transfer arrangement, where a vendor builds and runs the team for a period and then hands it over. For the full comparison, including shared services, read GCC vs ODC vs shared services.

Employers engaging developers abroad can read our guide to offshore developer contracts and compliance.

What developers cost in India

The table below reuses the current developer rows from the India hiring guide, with the same sources and dates. They are market ranges from a published Indian salary site, converted to US dollars at the rate stated in each row (INR 95.07 to the US dollar for the October 2026 rows). They are not offers or guarantees. The last row is the US median for the same occupation, shown as an onshore reference point.

The senior back-end row carries an earlier date (2025) because a senior band is not shown on the public page, so treat it as older and less reliable than the rows dated October 2026. The AI and machine learning row spans several experience bands, from the low end of the lowest band to the high end of the highest.

For the US anchor, the Bureau of Labor Statistics reports a median annual wage of $135,980 for software developers in May 2025, from its Occupational Employment and Wage Statistics programme, and about 1.7 million jobs in 2025 (OOH projections table). The Bureau projects employment for software developers, quality assurance analysts and testers to grow 10 percent from 2025 to 2035, much faster than the average for all occupations. The two sets of figures are not like-for-like: one is a national government survey of employer payrolls, the other a published market range for Indian roles. Use the comparison for direction and not as a precise ratio.

The salary table on this page is a market range for the person’s pay. It does not include what you pay on top of it. Indian employers owe contributions under social security and labour rules, and an employer of record adds its own fee. The rows in the table state that a provident fund and gratuity statutory load applies on top of the salary range for employees.

Statutory costs and compliance in brief

Employer costs in India sit on top of salary. The India hiring guide covers the Employees’ Provident Fund and state insurance contributions, the wage ceiling changes made in 2026 and gratuity. Contribution rates change, so ask your provider for the current schedule rather than budgeting from a figure quoted elsewhere. To add employer contributions and a provider fee to a salary, use the employee cost calculator.

The four labour codes took effect on 21 November 2025 according to the Ministry of Labour and Employment, rationalising 29 earlier laws. The points that matter most to a remote employer are the appointment letter for every worker, gratuity after one year for fixed-term employees and, for IT and ITES workers, salary payment by the 7th of each month. The guide India’s labour codes in 2026 explains what changed and what remains to be settled in state rules.

Developers handle code, credentials and sometimes customer data, so data protection applies as well. India’s Digital Personal Data Protection Act, 2023 and the Rules notified in November 2025 are summarised in the India hiring guide. Agree data-handling terms with the developer or the vendor before access is granted, and give accounts the least access needed.

Who owns the code: intellectual property in India

Intellectual property is the part of a developer contract that buyers most often leave until too late. The text below comes from the Copyright Act, 1957, as published by India’s Copyright Office. It is an orientation for the conversation with counsel, not legal advice, and the position should be confirmed by an Indian lawyer before you rely on it.

  • Computer programmes are literary works. Section 2(o) of the Act includes computer programmes in the definition of a literary work, and section 2(ffc) defines a computer programme as a set of instructions capable of causing a computer to perform a task.
  • The author is the first owner by default. Section 17 provides that the author of a work is the first owner of the copyright, subject to listed exceptions.
  • Employment is one exception. Under section 17(c), where a work is made in the course of the author’s employment under a contract of service or apprenticeship, the employer is the first owner in the absence of any agreement to the contrary. The exception turns on employment under a contract of service. A true independent contractor is not obviously within it, so the contractor’s contract should say who owns the code.
  • An assignment must be in writing. Section 19(1) says no assignment of copyright is valid unless it is in writing signed by the assignor or the assignor’s authorised agent. Section 19(2) requires the assignment to identify the work and to specify the rights assigned, the duration and the territorial extent.
  • Defaults can surprise a foreign buyer. Section 19(5) deems the period to be five years from the date of assignment if none is stated, and section 19(6) presumes the territorial extent to be India if none is specified. A contract that is silent on duration and territory may therefore transfer less than a buyer expects.

These points support three practical steps, which are RemoteStaffingWiki’s guidance and not a statement of law. Put a written assignment of all work product in the contract. State that the assignment covers the whole world and lasts for the full term of copyright. Have an Indian lawyer review how the clauses interact with the royalty and revision provisions of section 19. If the developer is employed through an employer of record or a vendor, check that the provider’s own contract with the developer contains an assignment that can be passed on to you.

Working hours and time-zone overlap

India uses a single time zone, India Standard Time at UTC+5:30, according to the India hiring guide. US Eastern time is UTC-5 in winter and UTC-4 in summer, so India is 10.5 hours ahead of New York in US winter and 9.5 hours ahead in US summer. By the same arithmetic, India is 5.5 hours ahead of London in UK winter and 4.5 hours ahead in UK summer, because UK clocks move to UTC+1 in summer.

The overlap is larger with the UK than with the US. A US morning is an Indian evening, so US-facing teams usually agree a shifted schedule for part of the team or work asynchronously with a written daily handover. Common patterns are a late-day shift for the developer, a short fixed overlap window for stand-up and review, and a clear rule for who can approve a release outside the overlap.

Daylight saving changes the overlap twice a year and on different dates in the US and the UK. Use the time-zone overlap tool to check your own dates and to see how many working hours the two sides share.

How to interview and vet a developer

The checklist below is RemoteStaffingWiki’s recommended process for a first hire. It is not a legal requirement, and you can adjust it to your stack and risk.

  • Write the role in terms of work, not titles. Name the stack, the seniority, the expected overlap hours and the first three outcomes you want in 90 days.
  • Screen portfolios and public code. Look for real ownership of shipped work and ask what the candidate personally built.
  • Test spoken and written English in a live conversation plus a short written task, such as explaining a past technical decision in an email.
  • Give a time-boxed work sample in your real stack and pay for the candidate’s time where the task is substantial. Review it with a technical person, even if only for an hour.
  • Speak to at least one previous team lead and ask about reliability, communication and how the person handled a production incident.
  • Ask about the working set-up: backup power, backup internet, a secure laptop and how the person protects credentials.
  • Confirm the contract chain. Know who employs the developer, who owns the code and who is responsible for payroll, tax and statutory registrations.

The cost-to-hire guide for a remote developer sets out the stages and where hiring effort goes, and the salary benchmark explorer lets you compare the rows above with other countries.

Common questions in one place

The FAQ below answers the questions buyers raise most often about hiring developers in India. The short version is that the talent pool is large, the legal structure is the part to get right, and a written intellectual property assignment is not optional.

FAQ

Can I hire a software developer in India without an Indian company?
Yes. You can employ the developer through an employer of record that employs them under Indian law while you direct the work, or engage a genuinely independent professional or vendor on a services contract. An Indian entity is mainly worth its fixed cost once you expect a larger, longer-term team. Confirm the structure with an Indian lawyer before you start.
How much does a software developer cost in India?
The table on this page shows market ranges from a published Indian salary site, dated October 2026 for most rows. For example, a mid-level full-stack developer is shown at $800 to $900 a month and a DevOps or cloud engineer at $500 to $1,200 a month, before statutory employer costs and any provider fee. The US median for the same occupation is $135,980 a year according to the Bureau of Labor Statistics, though the two figures come from different kinds of source.
What is the difference between an ODC and a GCC?
An offshore development center is a dedicated team that usually sits with a vendor and works only for you. A global capability centre is a centre owned by the company itself, with its own Indian entity. A vendor-run ODC is quicker to start and needs less setup, while a captive centre gives more control but brings entity, compliance and management overhead. The comparison page on this site sets the two side by side.
Who owns the code an Indian developer writes for me?
It depends on the contract. Under section 17(c) of the Copyright Act, 1957, an employer is the first owner of a work made in the course of employment under a contract of service, unless there is an agreement to the contrary. For an independent contractor the default is less clear, so the contract should include a written assignment. Section 19 requires an assignment to be in writing and to state the rights, duration and territory, so have an Indian lawyer review it.
Is an independent contractor or an employer of record better for one developer?
RemoteStaffingWiki’s guidance is to use an employer of record when the developer will work full time on your schedule and take your direction, and to use a contractor when the work is a defined project with clear deliverables. If you set hours and methods for a contractor, the relationship may be treated as employment. That is the site’s judgement, and an Indian lawyer can confirm how it applies to your case.
What time zone do Indian developers work in, and how much overlap will I get?
India Standard Time is UTC+5:30 and does not change with the seasons. India is 10.5 hours ahead of New York in US winter and 9.5 hours ahead in US summer, so a US morning is an Indian evening. For the UK, India is 5.5 hours ahead in UK winter and 4.5 hours ahead in UK summer. The time-zone overlap tool on this site shows the shared hours for your own dates.
How good is English among Indian developers?
India ranked 74th of 123 countries in the EF English Proficiency Index 2025, with a score of 484, in the low band. The index samples self-selected online test-takers, so it describes a national average rather than any individual. Test every candidate with a live conversation and a short written task instead of relying on a national ranking.
What statutory costs apply to an Indian employee on top of salary?
Employers owe contributions under Indian social security and labour rules, including the Employees’ Provident Fund and state insurance, and gratuity applies after the qualifying service period. The four labour codes took effect on 21 November 2025. Rates and ceilings change, so use the employee cost calculator for an estimate and ask your provider for the current schedule.
