The short answer
Brazil is a practical place to hire software developers if you are comfortable with two things: a time zone that is only one or two hours ahead of US Eastern time, and an employment law system that gives employees a lot of statutory protection. The talent side is well documented. The legal side is where a first-time buyer should plan carefully, because the way you engage a developer in Brazil decides how much risk you carry.
RemoteStaffingWiki’s guidance for a full-time developer who will work your hours and take your direction is to hire them as an employee under Brazil’s labour code, usually through an employer of record, and to reserve the contractor route (a company owned by the developer, known as a PJ) for work that is genuinely independent. That is the site’s judgement, based on the legal text and the court activity described below, not a legal opinion.
This page covers why companies look at Brazil for developers, the two main engagement models, the pay and employer-cost picture, data protection for a US client, time zone and English, and a vetting checklist. All salary figures are market ranges rather than offers, and every legal point should be confirmed with Brazilian counsel before you sign anything.
Why companies look at Brazil for developers
Brazil has a large domestic technology sector, and the Brazil guide notes that the domestic payments, banking and online retail sectors tend to give engineers experience of high-volume consumer systems. The industry association Brasscom, in a study published on 1 December 2021, projected demand for 797,000 new technology professionals between 2021 and 2025, an average of 159,000 a year, against about 53,000 people graduating from technology courses each year. The study is dated and the 2025 horizon has passed, so treat it as evidence of the scale of the market and of the competition for experienced people, not as a current vacancy count.
Brazil’s working day sits close to the US day. Brasília time is UTC-3 and, according to the Brazil guide, daylight saving remains suspended, so the offset does not change in the summer. The gap to US Eastern time is therefore two hours in US winter and one hour in US summer. The time-zone overlap tool shows the exact overlap with your own office for any date. Against US Pacific time the shared window is shorter but still workable for daily standups and pairing.
English is the practical constraint. In the EF English Proficiency Index 2025, which ranked 123 countries and regions and was released on 19 November 2025, Brazil placed 75th with a score of 482, in the low band. The index samples people who choose to take an online test, so it understates the English of developers who already work in international teams. It is still a fair warning that you should test spoken and written English for every candidate rather than assume it.
For the wider picture, including the main technology hubs, the cost of living and how Brazil compares with neighbouring countries, read the Brazil hiring guide. For a regional view of how Brazil sits against other Latin American options, see hiring remote staff in Latin America.
What a software developer does in a Brazilian team
The role itself is the same as anywhere: building, testing and maintaining software. The RemoteStaffingWiki software developer role guide covers the job description, interview structure and skills by seniority. The Brazil-specific questions are different. Which level do you need, how is pay quoted locally, and how is the person engaged? The rest of this page answers those three.
Pay in Brazil is usually quoted in reais, either as a monthly salary for employees or as a monthly invoice for contractors. Seniority bands in the market are commonly written as júnior, pleno (mid-level) and sênior. The salary table below uses mid-level and senior bands for software developers, and adds DevOps, mobile and QA rows because small businesses often hire those adjacent roles first.
Engagement model 1: employee under the CLT, usually through an employer of record
The Consolidation of Labour Laws, known as the CLT, governs employment in Brazil. It applies to a person working in Brazil whichever company they work for, which is why a foreign company without a Brazilian entity still has to think about it. The Brazil guide on this site sets out the main points: a written contract, remote work expressly stated in that contract, and equipment and expense responsibility set out in writing.
An employer of record is a local company that legally employs the developer under a Brazilian contract, runs payroll, contributions and filings, and invoices you for the cost plus a fee, while you direct the daily work. For one or two developers this is the route that avoids setting up your own Brazilian company. The trade-off is a fee on top of the statutory costs. Ask any provider how it handles the federal employer reporting system (eSocial), how termination works and what is included in the fee.
The statutory amounts that sit on top of base salary are the main reason a Brazilian employee costs more than the headline figure. Summarised from the Brazil guide, which cites the underlying statutes:
- 13th salary: one-twelfth of December pay for each month worked in the year (Law 4,090).
- Vacation: 30 days after each 12 months of service, paid with at least one third more than normal pay (CLT Article 130; Constitution, Article 7, XVII).
- FGTS severance fund: a monthly deposit of 8 percent of pay (Law 8,036, Article 15), plus a further 40 percent of the fund balance if the employer dismisses without cause.
- Social security: employer contributions under Law 8,212, which vary by activity, so ask your provider for the current schedule.
- Notice: 30 days, increasing by 3 days for each year of service up to 90 days (Law 12,506).
The Brazil guide also records that Constitutional Amendment 141, promulgated on 16 October 2026, phases the legal working week down from 44 to 42 hours and then to 40 hours, with two paid weekly rest days; according to Agência Senado the 42-hour step applies around mid-December 2026 and the 40-hour step 14 months after publication. Confirm the timetable and its effect on your contract with counsel. To turn a salary into a fully loaded annual figure, use the employee cost calculator, which includes Brazil.
Engagement model 2: PJ contractor, and the pejotização risk
Many Brazilian technology professionals work through their own company and invoice clients. This is the pessoa jurídica, or PJ, arrangement, and it is common in the technology sector. Brazilians call the practice of using it to cover what is in substance an employment relationship pejotização.
The tension is in the CLT itself. Article 442-B recognises a properly formalised autonomous contractor, but Article 3 defines an employee as someone who provides non-occasional services under the employer’s direction and for pay. The Brazil guide on this site draws the practical conclusion: if the contractor works set hours, takes daily instructions and has no other clients, the label on the contract does not remove the risk. Brazilian labour courts look at the facts of the relationship.
What the Supreme Court is deciding
Brazil’s Federal Supreme Court (STF) is considering the validity of engaging independent contractors under Theme 1389 (case ARE 1,532,603). A law-firm summary states that the final ruling is expected to clarify the validity of alternative contracting arrangements and the jurisdictional and evidentiary standards for disputes over alleged misclassification, and another says the decision will be binding on all trial and appellate courts in similar cases.
According to the first of these summaries, from an international employment-law firm alliance (a law-firm summary, not an official source), the STF suspended labour claims on this question in April 2025, lifted the suspension in June 2026 so that cases can again move through the evidentiary stage and trial courts, and requires them to be suspended again after judgment pending the final ruling. The same summary states that the STF has yet to issue a final ruling on Theme 1389 and that the key questions on classification and validity of these arrangements remain unresolved. The second law-firm summary describes the practice as widespread in technology, communications and healthcare, with critics saying it can conceal employment and deny rights such as paid vacation and a year-end bonus.
The practical reading, and RemoteStaffingWiki’s judgement, is that the law on this point is unsettled, so a buyer should not rely on a favourable outcome. If a full-time developer would be treated as part of your team in every practical way, RemoteStaffingWiki’s judgement is to start from employment. Genuine PJ engagement fits defined projects with deliverables, the contractor’s own tools and schedule, and other clients.
Two reference pages on this site help with the decision: the comparison of EOR, AOR and contractor of record and the glossary entry on misclassification.
| Question | Employee (via employer of record) | PJ contractor |
|---|---|---|
| Who the developer contracts with | A local employer that employs them under a CLT contract | Their own company, which invoices you |
| Direction of daily work | You direct the work, within the contract | The contractor decides how to deliver; you specify outputs |
| 13th salary, vacation premium, FGTS | Apply by law and are part of the employer cost | Not payable by the contracting company; the PJ pays its own taxes. A court could still reclassify the relationship |
| Main legal risk | Employer errors in payroll, filings or termination | Reclassification as an employee, with back obligations |
| Best fit (RemoteStaffingWiki’s judgement) | A full-time developer embedded in your team | A defined project with independent delivery and other clients |
Ownership of the code, confidentiality and the engagement form are covered in our guide to offshore developer contracts and compliance.
Salary ranges for developers in Brazil
The table below reuses the current developer rows from the Brazil country guide, with the same sources and dates. They are market ranges from a published salary site, converted to US dollars at the rate stated in each row, and they are not offers or guarantees. Annual figures for employees are before the 13th salary and vacation premium shown in the row.
For a reference point from the buyer’s side, the table also carries the US Bureau of Labor Statistics median annual wage for software developers (standard occupational classification 15-1252) from the May 2025 Occupational Employment and Wage Statistics, which was $135,980, covering 1,687,890 jobs. The two sets of figures are not like-for-like. They come from different survey methods, one covers Brazil and one the United States, and employer costs and benefits differ, so use them to set expectations and not to calculate a saving.
Use the salary table, then build your own fully loaded figure with the employee cost calculator and compare with other markets in the salary benchmark tool.
A full-cost view of hiring a developer remotely, including recruiting, equipment and management time, is in the guide to the cost to hire a remote developer. To compare pay across roles and countries, open the salary benchmark.
Data protection when a Brazilian developer touches your data
If your developer handles personal data, Brazil’s general data protection law, Law 13,709 (LGPD), is relevant. The official English text published by the national data protection authority (ANPD) says in Article 3 that the law applies to any processing carried out by a person or company of either public or private law, whatever the country of its headquarters or where the data are located, provided the processing is carried out in Brazil, is aimed at people located in Brazil, or concerns data collected in Brazil. A US company whose developer works from São Paulo is therefore likely to have processing carried out in Brazil.
Other articles worth knowing about when you design the set-up:
- Article 33 sets the conditions for international transfer of personal data, including adequate protection in the destination country, standard contractual clauses, specific contractual clauses, or the data subject’s specific and distinguishable consent.
- Article 41 requires the controller to appoint a data protection officer and publish their identity and contact details, subject to any waiver the national authority sets.
- Article 48 requires the controller to notify the national authority and the data subject of a security incident that may result in relevant risk or damage.
- Article 52 allows administrative sanctions, including a fine of up to 2 percent of revenue in Brazil in the previous fiscal year, limited to R$50 million per infraction.
In practice, give a developer access only to the data the task needs, prefer test or anonymised data in development environments, put confidentiality and security obligations in the contract, and ask counsel whether your set-up needs standard contractual clauses for transfers between Brazil and the United States. Which party is the controller depends on how the data is used, so this is a question for a lawyer rather than a default answer.
Intellectual property and the contract
Ownership of code written by an employee or a contractor matters for developer hires. Have Brazilian counsel confirm IP assignment wording under Brazil’s software and copyright laws before signing, and confirm in writing how ownership of the work product passes to you under both models, whether a written assignment is needed for a PJ contractor, and how the clause should be worded in Portuguese so that it is enforceable locally. Do not assume that a US-style work-for-hire clause works the same way in Brazil.
Time zone and working practices
With a one to two hour gap to US Eastern time, a Brazilian developer can attend a morning standup and overlap for much of a US East Coast working day. Fix the overlap hours in writing, name an escalation contact for out-of-hours incidents, and use the time-zone overlap tool to check the position for your own team.
Public holidays are a planning point. Brazilian and US holiday calendars differ, so agree a shared holiday calendar at the start of the engagement. Employees under the CLT are entitled to 30 days of vacation after each 12 months of service, so agree how far in advance leave is requested.
Vetting checklist for Brazilian developers
The checklist below is RemoteStaffingWiki’s own guidance, not a legal or regulatory requirement.
- Define the work first: stack, seniority, whether the role is full-time and whether you will direct daily tasks. This decides employee versus PJ.
- Run a work-sample test in the real stack, reviewed by someone technical on your side.
- Hold a live English conversation and set a short written task, such as explaining a pull request.
- Check references from a previous team lead, and check that portfolio code or public repositories match what the candidate says they built.
- Confirm the legal form of engagement in writing before work starts, and have counsel review the contract.
- Agree intellectual-property ownership and confidentiality terms in a document that counsel has reviewed for Brazil.
- Decide how data access, device security and offboarding will work before day one.
- Plan the time-zone overlap, holiday calendar and a probation or review point.
Next steps
If you are still deciding whether Brazil is the right country, compare it with other markets in the Brazil guide and the regional overview. If you have decided, write the role scope, choose the engagement model with counsel, and cost the hire in the employee cost calculator before you open the search.
